The Kentucky Office of Unemployment Insurance can recoup overpayments through income tax refunds that may be intercepted in order to satisfy your repayment obligation, pursuant to KRS 341.415. However, overpayments resulting from office error will be recovered only by deducting 25% of the weekly benefit rate from any future benefits.
The unemployment office has so far approved debt relief to just over a third of those individuals who received letters. Kentucky-based attorneys and national advocates say this restrictive approach to overpayment waivers may leave people saddled with debt they shouldn’t have to pay.
