"Step Right Up" is a song written by Tom Waits and included on his 1976 album Small Change. The song became the subject of a lawsuit between Waits and Frito-Lay Inc., after using a similar-sounding song in one of their commercials without the approval of Waits.
Small Change was recorded, direct to 2-track stereo tape, July 15, 19–21 and 29, 1976, at Wally Heider's Studio 3 in Hollywood [2] under the production of Bones Howe.A multi-track recording was made as back up, and used when a reference Waits made to actress Jayne Meadows had to be changed. [3]
The group's first single, "Step Right Up", was released on December 9, 1997. [4] It peaked at number 62 on the Billboard Hot Country Singles & Tracks chart. [1] A music video for the song aired on CMT. [2] In 2011, Atkinson formed the duo Blue Cactus Choir with Katy Boyd. [5]
The album gave him three of his biggest hits including "My Hometown." His next release was a live disc called "Unleashed Live," which is credited to Charlie, brother Bruce, and Jack Ingram. He then signed with Columbia Records for "Step Right Up" and another live album.
