Title 40 is a part of the United States Code of Federal Regulations. Title 40 arranges mainly environmental regulations that were promulgated by the US Environmental Protection Agency (EPA), based on the provisions of United States laws (statutes of the U.S. Federal Code). The "Derived-from Rule" (40 CFR Section 261.3(b)) applies to a waste that is generated from the treatment, storage or disposal of a hazardous waste (for example, the ash from the incineration of hazardous waste). Wastes "derived" in this manner may be regulated as hazardous wastes.
HAZWOPER applies to five groups of employers and their employees.
