The Preemption Act of 1841 permitted "squatters" who were living on federal government-owned land to purchase up to 160 acres (65 ha) for $1.25 per acre ($3.09 per hectare) before the land would be offered for sale to the general public. To qualify under the law, the "squatter" had to be the following:
The claimed homestead could include the same land which they had previously filed a preemption claim (on up to 160 acres at $1.25 per acre, or up to 80 acres of subdivided and surveyed land at $2.50 per acre), and they could expand their current ownership to contiguous adjacent land up to 160 acres total.
But to encourage more sales and make them more affordable, Congress also reduced both the minimum price (from $2.00 to $1.25 (equivalent to $28 in 2024 [1]) per acre ($495 to $309/km 2)) and the minimum size of a standard tract (from 160 to 80 acres (647,000 to 324,000 m 2)). The minimum full payment now amounted to $100, rather than $320. [2]
The legal description of a 2.5-acre (10,000 m 2) property under the Lot and Block system may be something like; Lot 5 of Block 2 of the South Subdivision plat as recorded in Map Book 21, Page 33 at the Recorder of Deeds.
After he died in 1789, responsibility for surveying was transferred to the Surveyor General. Land was to be systematically surveyed into square townships, 6 mi (9.7 km) on a side, each divided into thirty-six sections of 1 sq mi (2.6 km 2) or 640 acres (260 ha). These sections could then be subdivided for re-sale by settlers and land speculators.
The primary grid pattern is of quarter sections (1 ⁄ 2 mi × 1 ⁄ 2 mi (800 m × 800 m)). In U.S. land surveying under the Public Land Survey System (PLSS), a section is an area nominally one square mile (2.6 square kilometers), containing 640 acres (260 hectares), with 36 sections making up one survey township on a rectangular grid.
