The Sheriff of Lincoln County, William J. Brady, was an Irish immigrant from County Cavan and was allied to the House. Tunstall was eager to make money in Lincoln County. Offering decent prices and reasonable dealings at his store, he attracted locals eager to find a competitor to Murphy and Dolan.
Sheriff Brady formed a posse to attach Tunstall's remaining assets at his ranch 70 miles from Lincoln. Dolan also enlisted the John Kinney Gang, Seven Rivers Warriors and the Jesse Evans Gang, and their job was mainly to harass and rustle cattle from Tunstall's and Chisum's ranches, as well as being the faction's hired gunmen. On April 18, 1878, Billy the Kid, John Middleton, Fred Waite and Henry Newton Brown were indicted for the murder of Sheriff Brady. On the same day, Dolan, Deputy Jesse Evans, Deputy William Matthews and others were indicted for the murder of John Tunstall. On May 15, 1878, Manuel Segovia, the cowboy who had killed Frank McNab, was captured.
In February 1878, a posse was dispatched by Sheriff Brady to arrest rancher John Tunstall. That posse included Jesse Evans, William Morton, Frank Baker, Tom Hill and Dolly Graham, all members of Evans' gang. They ambushed and murdered Tunstall on February 18, 1878, which ignited the Lincoln County War.
As the Sheriff lay dead, Billy the Kid ran from the place of ambush in order to remove the arrest warrant from Brady's pocket. Instead, he was driven back and slightly wounded by the gunfire of one of Brady's Deputies. Several other killings following this were committed by both the Regulators and the gunmen employed by Murphy-Dolan.
Sheriff Brady died of at least a dozen gunshot wounds in the back. Deputy Sheriff George W. Hindman was hit twice, fatally.
