This guide describes the process of challenging an order of a court or administrative tribunal by filing an appeal in the Michigan Court of Appeals. An appeal is a way to ask a court to correct an error made by a lower court. The Michigan Court of Appeals is the intermediate appellate court in this state.
Cases filed with the Court of Appeals are resolved by order or opinion. Dispositions by order generally occur in appeals by leave when the Court denies the application. Opinion dispositions typically occur in appeals by right and in those cases where leave to appeal is granted.
Decisions of the Court of Appeals may be appealed to the Michigan Supreme Court. An appeal is not a new trial. There are no witnesses. The person filing the appeal (“the appellant”) files documents to persuade the Court of Appeals a legal error happened and the result must be changed.
2.1 Appeals to Circuit Court. The rules in MCR 7.101 et seq. govern the procedure for appealing to the circuit court. MCR 7.101(A). The rules set out in subchapter 7.100 of the Michigan Court Rules “do not restrict or enlarge the appellate jurisdiction of the circuit court.” MCR 7.101(B).
Since 2013 the Court of Appeals has also been home to the Michigan Court of Claims, which has jurisdiction over claims made against the State of Michigan. Four of the Court of Appeals’ judges are assigned every two years to handle a variety of trial court matters as Court of Claims judges.
