The Supreme Court is third in the adjudicative hierarchy of the Bahamas. Appeals made by the Supreme Court can be struck down by the Court of Appeal, which is the highest domestic court in the Bahamas; appeals can be made from either court to the Judicial Committee of the Privy Council, which is the highest court for the country. The basis of the Bahamian Law and legal system lies within the English Common Law tradition. Justices of the Supreme Court, Registrars and Magistrates are all appointed by The Governor-General acting on the advice of the Judicial and Legal Service Commission, which is composed of five individuals who are headed by the Chief Justice as their chairman.
In 2011, Bahamian Chief Justice Sir Michael Barnett said The Bahamas should eventually abandon the Privy Council as the final court of appeal and move toward the Caribbean Court of Justice (CCJ). While that decision would be up to the government of The Bahamas, Sir Michael said there is a "powerful argument to moving eventually toward the CCJ".
