The Constitution of Mongolia adopted in 1992 states that the President of Mongolia is the "head of state and embodiment of the unity of the Mongolian people". [1]Mongolia declared its independence from the Qing dynasty during the Mongolian Revolution of 1911, [a] under the Bogd Khan (the 8th Jebtsundamba Khutuktu).
It is established by Article 48(1) of the Constitution of Mongolia. The 1992 Constitution states in Article 50(1) that "the Supreme Court shall be the highest judicial organ". [1] The Supreme Court has jurisdiction over serious criminal matters, receives appeals from lower-instance courts.
The 2024–2028 State Great Khural is the current session of the State Great Khural. Its members were first elected in the 2024 Mongolian parliamentary election and assumed office on 2 July 2024. The first session convened on 2 July 2024, and is scheduled to be seated until July 2028.
The 2020–2024 State Great Khural was the eighth session of the State Great Khural which first convened on 2 July 2020 and was seated until 2 July 2024. Its members were first elected in the 2020 parliamentary election held on 24 June 2020.
The Supreme Court is constitutionally empowered to examine all lower court decisions—excluding specialized court rulings—upon appeal and provide official interpretations on all laws except the constitution. Specialized civil, criminal, and administrative courts exist at all levels and are not subject to Supreme Court supervision.
The 2016–2020 State Great Khural was the seventh session of the State Great Khural which first convened on 5 July 2016 and remained in session until 2 July 2020. Its members were first elected in the 2016 parliamentary election held on 29 June 2016.
The highest court in Mongolia is the Supreme Court of Mongolia (Улсын Дээд Шүүх), [7] established in 1927. There are chambers for civil, criminal and administrative cases. The court hears general appeals from courts of lower instance as well as from the Constitutional Court in matters regarding the protection of law and human rights.
In 2022, due to the amendment of the Constitution, members of the Parliament can serve as members of the cabinet without any limit. A cabinet reshuffle occurred, and 9 members of the State Great Khural were appointed as members of the cabinet. [4] Currently, 16 out of 22 ministers, including the prime minister, are members of the parliament.
