The California Environmental Quality Act (CEQA / ˈ s iː. k w ə /) is a California statute passed in 1970 and signed in to law by then-governor Ronald Reagan, [1] [2] shortly after the United States federal government passed the National Environmental Policy Act (NEPA), to institute a statewide policy of environmental protection.
It also mandated that unlicensed centers post notice of their unlicensed status. The centers, typically run by Christian non-profit groups, challenged the act on the basis that it violated their right free speech. The law was subsequently struck down as unconstitutional in a 5–4 decision along ideological lines by the U.S. Supreme Court.
Pursuant to the California Administrative Procedure Act, a "Notice of Proposed Action" is published in the California Regulatory Notice Register (Notice Register) and at least 45 days are required for public hearings and comment before being reviewed and approved by the California Office of Administrative Law (OAL) and codified in the CCR. The act provides immunity to the State of California and its related entities from being sued. The law immunizes public employees from liability for “instituting or prosecuting any judicial or administrative proceeding” within the scope of their employment, “even if” the employees act “maliciously and without probable cause.” (Cal.
