Two days after the shootings, Miller briefly appeared in court by video and requested a lawyer. He was charged with one count of capital murder, covering all three deaths because the crime was "part of a common scheme or course of conduct." Miller is believed to be the oldest person to be charged with capital murder in the history of Kansas. [31]
