The reason the flag is black and white is because it is used on soldiers uniforms instead of red white and blue so they don't get shot. Red stands out, black doesn't. Veterans from the military, having spent the careers wearing the black and white flag, tend to like it after they get out of the military too. It's literally as simple as that.

Pirates used a red flag for no quarter and a black flag to indicate that they were pirates and not a ship of a nation in general. Pirates aren't organized and while I recall reading about a ship that used a black flag in the way you say, it wasn't apparently that widespread. The black flag primarily indicated "pirate".

To my knowledge, the black flag was the original "pirate" flag (before hollywood tacked on the skull and crossbones trope) and a solid black american flag is known to mean "take no prisoners"; derived from the solid black confederate flag (not the stars and bars which was a WV Battle flag, the actual confederate one that was made to emulate the first Union flag) which was used by Reb irregulars.
while it appears to be black, this is actually a massive red flag. Am American, and currently stuck amongst Christofascists. That is EXACTLY who uses the flag. On one hand, it's disgusting. On the other, PLEASE identify yourselves clearly and stop stealing the nation's flag to perpetuate your political views.
