The Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), also known as "Superfund", requires that the criteria provided by the Hazard Ranking System (HRS) be used to make a list of national priorities of the known releases or threatened releases of hazardous substances, pollutants, or contaminants in the United States. The National Priorities List, a branch of the Environmental Protection Agency (EPA), also states that groups operating with fewer than 100 full-time employees are also exempt from former Superfund agreements. Additionally, the president retains the ability to override any exemptions he deems necessary due to maltreatment of natural resources.
Importantly, CERCLA does not preempt state clean-up laws and when passed, it did not distinguish between small and large generators of hazardous waste. In order to remediate a site, a party must comply with both state and EPA guidelines. There is no guarantee that compliance with state requirements will prevent further EPA regulation in the future.
