A court clerk (British English: clerk to the court or clerk of the court / k l ɑːr k /; American English: clerk of the court or clerk of court / k l ɜːr k /) is an officer of the court whose responsibilities include maintaining records of a court and administering oaths to witnesses, jurors, and grand jurors [1] [2] as well as performing some quasi-secretarial duties. The main purpose of the system is to fulfill the legal obligation of the Clerk of Court as custodian of court records. Each case is assigned a number in the format D:YY-TT-SSSSS where D=Division Office (most districts are split into divisions), YY=Year, TT=Type (e.g. bk=bankruptcy, cv=civil, cr=criminal), SSSSS=Sequence number.
Other documents such as deeds, mortgage documents, name change documents, and divorce records, as well as marriage certificates for those states not centralizing these records, are maintained by the clerk of court of each individual county. However, the term "civil registry" is not used.
The electronic document stamp shall be used for the purpose of confirming the authenticity of the transmission and associated document(s) with the Clerk of Court, as necessary. When a document has been electronically filed into CMIECF, the official record is the electronic recording of the document kept in the custody of the Clerk of Court.
