The California Administrative Procedure Act (APA) is a series of acts of the California Legislature first enacted 15 June 1945 that requires California state agencies to adopt regulations in accordance with its provisions. It "addressed only the availability of civil remedies for business violations in cases of penalty, forfeiture, and criminal violation." The author, Paul Mason (1898–1985), was a scholar who worked for the California State Senate. He is best known for writing Constitutional History of California in 1951 and Manual of Legislative Procedure in 1935. The National Conference of State Legislatures (NCSL) was assigned copyright ownership by Mason prior to his death.
The U.S. Constitution takes priority over the California constitution so courts may still be obliged to exclude evidence under the federal Bill of Rights.
