In the mid-1980s, Martinko's father filed a lawsuit against the owners of the Westdale Mall and claimed negligence in not providing "reasonable security" on the night of the murder. The case was appealed and was eventually decided by the Iowa Supreme Court in favor of the mall owners. [2] Martinko's father, Albert, died in 1995.
