Virgil Clark Smith (born July 4, 1947) is a judge of the 3rd Circuit Court in Wayne County, Michigan. He was appointed to fill a vacancy in this court by Michigan Governor Jennifer Granholm. Smith has served as a member of the Michigan House of Representatives and as a Michigan state senator. He represented a district in Detroit.
In November 1992, Hathaway was elected judge of the Wayne County Circuit Court, 3rd Judicial Circuit, and served from 1993 until 2009, when she was elevated to Michigan Supreme Court Justice. In 2006, Hathaway mounted an unsuccessful campaign for a seat on the state Court of Appeals. She finished third behind two sitting judges. [4]

She was appointed to the Third Circuit Court in 1999 by then-Gov. John Engler, where she served for 11 years. She became the first woman to serve as Chief Judge of that court when the Michigan Supreme Court appointed her in 2002. She served as Chief Judge until 2007.
