If schools fail to comply to the child's IEP, the school district may be put on trial. Parents have the option of refusing Special Education services for their child if they choose. Under IDEA, students with disabilities are entitled to receive special education services through their local school district from age 3 to age 18 or 21.
Prior to Zebley, a child would only be found disabled under the SSA's definition if he or she medically met or equaled one of SSA's listings of impairments. [4] Following the ruling, the childhood definition of disability was changed to having "an impairment resulting in marked and severe functional limitations."
The Individuals with Disabilities Education Act (IDEA) includes occupational and physical therapy as well as other therapies, as part of the special education that should be offered in all public schools to CSHCN. This act states that all children with disabilities should have access to education that suits their SHCN, including needed therapies.
The Office of Special Education and Rehabilitative Services (OSERS) is a program of the United States Department of Education. [4] OSERS' official mission is "to provide leadership to achieve full integration and participation in society of people with disabilities by ensuring equal opportunity and access to, and excellence in, education, employment and community living."
Before the 1970s, there were no major federal laws that protected the civil or constitutional rights of Americans with disabilities. The civil rights movement started off the "disability rights movement", which focused on social and therapeutic services for those with disabilities, and in 1975 the Individuals with Disabilities Education Act (IDEA) was created.
The regulations further state that "special classes, separate schooling or other removals of children with disabilities from regular educational environment occurs only if the nature or severity of the disability is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily."
Emotional and behavioral disorders (EBD; also known as behavioral and emotional disorders) [1] [2] refer to a disability classification used in educational settings that allows educational institutions to provide special education and related services to students who have displayed poor social and/or academic progress. [3]
Developmental disability is a diverse group of chronic conditions, comprising mental or physical impairments that arise before adulthood. Developmental disabilities cause individuals living with them many difficulties in certain areas of life, especially in "language, mobility, learning, self-help, and independent living". [ 1 ]
