Local councils have powers to make byelaws under various Acts of Parliament. The power to make byelaws "for the good rule and government" of their area, granted by the Local Government Act 1972, appears to be very sweeping, however this power is greatly limited by the restriction that it cannot be used in connection with anything already covered under other legislation.
The Act replaces the process for Welsh ministers and the UK ministers to approve byelaws made by local authorities in Wales. [4] The Supreme Court ruled that the provisions removing powers of UK ministers were "incidental to" and "consequential on" the main purpose of the law, which was to remove powers of the Welsh ministers.
The UK, in common with a number of other countries, began from the 1970s to reconsider hitherto settled local government models.
