The never exceed speed is quoted as 285 kts, where as the max speed is 370 kts. V_ne is a structural limit where as the V_max is a performance limitation; as such I would expect that V_max is less than V_ne, or at least a note stating that V_max is TAS and V_ne is KEAS or IAS.
