DPS does their own backgrounds, save for the FBI fingerprint check. No local agencies are involved. DPS sends an employee into each county where you have lived for the last 5 years (5 I believe) to conduct an in person background. They check the county and district criminal clerk and District civil clerk. The tax assessor is also queried.

After waiting a 130 days, I called DPS on Friday, and was told by the person there that "something came up" on the background check. I said I listed my only misdemeanor arrest and dispostion on the application, and she said she would transfer me to the person working my file. Upon transfer, got the infamous voice mail. Left a msg. No response ...
The FBI uses NICS as a database of people who are prohibited from possessing or buying guns. In one of the documents, an ATF agent emailed the FBI that a person suspected of straw purchasing or firearms trafficking needed to be put into the gun background check database.

Wei just checked my status and its now manufacturing pending. That pretty fast seeing as they recived my application 7 days ago.
The fbi, arresting agency and jail you were in will have record still. So will the district attorney, district clerk and county clerk you were arrested in. The information can be used in later prosecutions. If you get your record sealed, a good background check will show you were arrested but it will not show a conviction or the offense committed.
