    The DWP have no legal powers to insist you pay back any overpayment of pension after notification of death unless he was already paying back a benefit he was not entitled to. They can send a letter requesting for the payment but they only send it once.

    I would suspect the DWP would try and say you're over the limit even if you pay everything on a credit card and the card's monthly DD takes the account under £6,000 when the bill is paid. It wouldn't really matter to the DWP it's what's in the account when or if they check the account of a claimant.

    They can still take other action and from next year DWP will be recovering HMRC debts and they can use direct earnings attachments so will take it from your pay before you receive it if you work. Since the 3 month time limit was introduced in April 2013 it has effectively stopped people in your position from taking any action.

    The DWP wanted Bank statements from Dec 1998 to Oct 2003 as apparently there was discrepancies as to capital held and what my Father was receiving in benefits. The Bank could only provide statements from July 2001 which I submitted to DWP. After further correspondence from them I have received a bill owing of £12562.98.

    In the DWP response to my tribunal appeal, the person explained that they'd looked at all correspondence and asked the tribunal to take away the points I felt I shouldn't have and thus not award me any PIP at all.     In my experience a phone call would not get acted upon. To prod the DWP to get anything done you always need to inform them in writing whether it would be for a name change or to report a change in circumstances eg health deterioration, however it is very important to send the letter by recorded or special delivery so you have a post office receipt and you will get a proof of delivery online.
