On November 16, 2015, a Clackamas County jury sentenced Rogers to death for the fourth time. According to his defense attorney, Rogers would have waived all future appeals and allocuted to his crimes in exchange for a true life sentence instead of the death penalty. [8] On November 12, 2021, his death sentence was overturned for the fourth time.
In 2004, the case was formally reopened by the Clackamas County Sheriff’s Office. [20] In a 2017 interview with Clackamas County Sheriff’s Office Sergeant John Krummenacker, it was revealed that evidence in the case—including the location of the woman's clothing, jawbone, dentures, and other remains—were unknown.
On Saturday, the Clackamas County Sheriff’s Office announced the arrest of 71-year-old Michel Fournier, who was charged with second-degree murder. Michel is reportedly the victim's husband.
The family alleged that the police used excessive force, made an unconstitutional arrest and caused a wrongful death, among other charges. In 2009 a one-million-dollar settlement with the city of Sandy was reached. [2] A settlement with Clackamas County of one million dollars was reached in March 2010. [5]
