The Federal Employees' Compensation Act (FECA), is a United States federal law, enacted on September 7, 1916. [1] [2] [3] Sponsored by Sen. John W. Kern (D) of Indiana and Rep. Daniel J. McGillicuddy (D) of Maine, it established compensation to federal civil service employees for wages lost due to job-related injuries.
The act provides immunity to the State of California and its related entities from being sued. The law immunizes public employees from liability for “instituting or prosecuting any judicial or administrative proceeding” within the scope of their employment, “even if” the employees act “maliciously and without probable cause.” (Cal.
