The Republic of Texas had formed in 1836, after breaking away from Mexico in the Texas Revolution. The following year, an ambassador from Texas approached the United States about the possibility of becoming an American state. Fearing a war with Mexico, which did not recognize Texas independence, the United States declined the offer. [1]

After spending some time raising money and volunteers in Tennessee for the Texas army, Childress left permanently for Texas. He arrived at the Red River on December 13, 1835, then illegally crossed the Red River into the nation of Mexico in violation of the Law of April 6, 1830. On December 12, 1838, the Texas Congress elected Rusk Chief Justice of the Republic's Supreme Court. He served until June 30, 1840, when he resigned to resume his law practice.
